NEA working party reviews nuclear liability issues related to transport and emerging technologies

Members of the NEA Working Party on Nuclear Liability and Transport (WPNLT) met in person and online on 9 April 2026 with 35 participants from 13 NEA member countries, Ghana, Ukraine, the IAEA, the International Nuclear Law Association (INLA), the World Nuclear Association (WNA) and World Nuclear Transport Institute (WNTI), as well as representatives from the nuclear insurance industry. 

The meeting of the WPNLT, which examines issues relating to the interpretation and application of international nuclear liability instruments to nuclear transport, included updates from the Secretariat and the IAEA, as well as presentations from INLA, WNA and WNTI. 

During the meeting, the working party discussed the potential impact of the 2025 Edition of the IAEA Regulations for the Safe Transport of Radioactive Material (SSR-6 (Rev.2)) on the 2016 Decision of the Steering Committee for Nuclear Energy on the Exclusion of Small Quantities of Nuclear Substances outside a Nuclear Installation from the Application of the Convention on Third Party Liability in the Field of Nuclear Energy [NEA/NE(2016)8/FINAL] and the 2014 IAEA Board of Governors Resolution on the Establishment of Maximum Limits for the Exclusion of Small Qualities of Nuclear Material from the Application of the Vienna Conventions on Nuclear Liability [GOV/2014/63].  

The meeting agenda also featured a topical session on nuclear liability and insurance challenges related to transportable and maritime small modular reactors (SMRs) from international, national and insurance perspectives. A fruitful discussion also addressed the issue of operators’ overlapping nuclear liability in the context of international transport, including a consideration of a specific case study illustrating this issue.
