Following the TEPCO Fukushima Daiichi nuclear power plant accident, extraordinary efforts were undertaken in Japan to implement a compensation scheme for the proper and efficient indemnification of the affected victims. This publication provides English translations of key Japanese legislative and administrative texts and other implementing guidance, as well as several commentaries by Japanese experts in the field of third party nuclear liability.

The OECD Nuclear Energy Agency (NEA) has prepared this publication in co-operation with the government of Japan to share Japan’s recent experience in implementing its nuclear liability and compensation regime. The material presented in the publication should provide valuable insights for those wishing to better understand the regime applied to compensate the victims of the accident and for those working on potential improvements in national regimes and the international framework for third party nuclear liability.

The Second International Workshop on the Indemnification of Nuclear Damage was held in Bratislava, Slovak Republic, from 18 to 20 May 2005. The workshop was co-organised by the OECD Nuclear Energy Agency and the Nuclear Regulatory Authority of the Slovak Republic. It attracted wide participation from national nuclear authorities, regulators, operators of nuclear installations, nuclear insurers and international organisations.

The purpose of the workshop was to assess the third party liability and compensation mechanisms that would be implemented by participating countries in the event of a nuclear accident taking place within or near their borders. To accommodate this objective, two fictitious accident scenarios were developed: one involving a fire in a nuclear installation located in the Slovak Republic and resulting in the release of significant amounts of radioactive materials off-site, and the other a fire on board a ship transporting enriched uranium hexafluoride along the Danube River. The first scenario was designed to involve the greatest possible number of countries, with the second being restricted to countries with a geographical proximity to the Danube. These proceedings contain the papers presented at the workshop, as well as reports on the discussion sessions held.

The accident at the Chernobyl nuclear power plant in 1986 heightened awareness of the need to improve the international legal framework governing the safe and peaceful uses of nuclear energy. Numerous legal instruments have subsequently been adopted.

This compendium examines the developments which have taken place in international nuclear law since 1986. It reproduces a number of articles which have been published in the OECD/NEA Nuclear Law Bulletin, accompanied by some previously unpublished works. The principal legal instruments examined in this publication govern early notification and assistance in the event of a nuclear accident, nuclear safety, the safety of radioactive waste and spent fuel, and nuclear liability and compensation.

This update is based on information which was made available to the NEA Secretariat by the end of 2003. The Workshop on the Indemnification of Damage in the Event of a Nuclear Accident, organised by the OECD Nuclear Energy Agency in close co-operation with the French authorities, was held in Paris from 26 to 28 November 2001. This event was an integral part of the International Nuclear Emergency Exercise INEX 2000. It attracted wide participation from national nuclear authorities, regulators, operators of nuclear installations, nuclear insurers and international organisations. The objective was to test the capacity of the existing nuclear liability and compensation mechanisms in the 29 countries represented at the workshop to manage the consequences of a nuclear emergency. This workshop was based upon the scenario used for the INEX 2000 Exercise, i.e. an accident simulated at the Gravelines nuclear power plant in the north of France in May 2001. These proceedings contain a comparative analysis of legislative and regulatory provisions governing emergency response and nuclear third party liability, based upon country replies to a questionnaire. This publication also includes the full responses provided to that questionnaire, as well as the texts of presentations made by special guests from Germany and Japan describing the manner in which the public authorities in their respective countries responded to two nuclear accidents of a very different nature and scale.

L'Atelier sur l'indemnisation des dommages en cas d'accident nucléaire, organisé par l'Agence de l'OCDE pour l'énergie nucléaire, en étroite collaboration avec les autorités françaises, s'est tenu à Paris du 26 au 28 novembre 2001. Cette réunion faisait partie intégrante de l'Exercice international d'urgence nucléaire INEX 2000. Elle a suscité une large participation des autorités nationales nucléaires, des instances de réglementation, des exploitants d'installaions nucléaires, des assureurs nucléaires et des organisations internationales. L'objectif était de mettre à l'épreuve la capacité des mécanismes actuels de responsabilité civile et de réparation des 29 pays représentés à l'atelier de gérer les conséquences d'une situation d'urgence nucléaire. Cet atelier était fondé sur le scénario utilisé lors de l'Exercice INEX 2000, c'est-à-dire une simulation d'accident à la centrale nucléaire de Gravelines dans le nord de la France en mai 2001. Ce compte rendu comporte une analyse comparative des dispositions législatives et réglementaires applicables aux situations d'urgence nucléaire et à la responsabilité civile nucléaire qui s'appuie sur des réponses nationales à un questionnaire, ainsi que les réponses complètes à ce dernier. Cette publication reproduit également les textes des présentations faites par des intervenants allemands et japonais décrivant la manière dont les autorités publiques dans leurs pays respectifs ont fait face à deux accidents nucléaires de nature et d'ampleur très différentes.

This is the first update of the 1999 Edition of the Analytical Study on Nuclear Legislation in OECD Member countries, prepared in co-operation with the competent authorities in the countries listed herein. As with the 1999 Edition, it is organised on the basis of a standardised format for all countries, thus facilitating the search for and comparison of information.

The 2001 Update consists of replacement chapters for Australia, Canada, Hungary, Italy, Japan, Luxembourg, Norway and Spain. In addition, there is a completely new chapter for the Slovak Republic, which became a member of the OECD on 14 December 2000, and which was not previously covered by this publication. An information note is also provided on Poland, pending revision of this chapter upon adoption of legislation to implement the new Polish Atomic Law.

This update is based on information which was made available to the NEA Secretariat by the time of its publication. Neither the NEA Secretariat nor the national authorities of the countries concerned assume any liability for it.

The International Symposium on the Reform of Civil Nuclear Liability, organised by the OECD Nuclear Energy Agency in co-operation with the International Atomic Energy Agency and the European Commission, was held in Budapest, Hungary, from 31 May to 3 June 1999. The event attracted over 200 participants from 50 countries, with a view to examining nuclear liability and compensation issues in the context of the recent revision of the Vienna Convention on Civil Liability for Nuclear Damage, the adoption of the Convention on Supplementary Compensation for Nuclear Damage and the current negotiations being carried out under the aegis of the OECD/NEA on the amendment of the Paris and Brussels Conventions. These proceedings reproduce all papers which were presented at the Symposium, and provide detailed records of the discussion periods.

Le Symposium international sur la réforme de la responsabilité civile nucléaire, organisé par l'Agence de l'OCDE pour l'énergie nucléaire en coopération avec l'Agence internationale de l'énergie atomique et la Commission européenne, s'est tenu à Budapest, en Hongrie, du 31 mai au 3 juin 1999. Ce symposium a regroupé plus de 200 participants venant de 50 pays, afin d'examiner les questions que se posent aujourd'hui en matière de responsabilité et de réparation des dommages nucléaires dans le contexte de la révision récente de la Convention de Vienne, de l'adoption d'une nouvelle Convention sur la réparation complémentaire des dommages nucléaires et, enfin, des négociaitons en cours au sein de l'OCDE/AEN sur l'amendement de la Convention de Paris et de la Convention Complémentaire de Bruxelles. Sont publiés dans ce recueil tous les rapports présentés dans le cadre de ce Symposium, ainsi que les comptes rendus détaillés des discussions.
